Terms of Service

Last updated October 23, 2026.

These terms govern your use of the superdurable.ai website, Dex AI Platform and Managed Dex Engine (the "Services"), provided by Super Durable, Inc. ("Super Durable", "we"). By creating an account or using the Services, you agree to these terms. If you use the Services for an organization, you agree on its behalf and confirm that you may do so. A signed agreement between your organization and Super Durable takes precedence over these terms where they differ.

1. Accounts

You are responsible for your account, for keeping its credentials secret and for everything done with it. Give us accurate information and tell us at hi@superdurable.io if you believe your account has been used without permission. You must be at least 18 years old to use the Services.

2. Your content

"Your Content" is what you or your applications put into the Services: process descriptions, messages to the agent, application code, files, run data, Attributes and connection settings. You keep all rights in Your Content. You give us a license to host, copy, process and transmit it only as needed to provide, secure and support the Services for you. We do not use Your Content to train AI models.

You are responsible for Your Content and for having the rights to give it to us, including personal data of other people. If you process personal data with the Services, you are the controller of that data and we process it on your instructions as described in our Privacy Policy.

3. AI-generated output

Dex AI Platform uses AI models to write code, answer questions and propose changes. Output can be wrong or incomplete. Review code and proposals before you publish them; changes reach production only after a person in your team approves them. You own the output generated for you, to the extent the law allows.

4. Connections to other services

When you connect a third-party service, such as Slack, Gmail or Salesforce, you authorize us to access it on your behalf as your applications require. Your use of that service is governed by its own terms. We are not responsible for third-party services, their availability or what they do with data you send them. If you provide your own AI model provider key, that provider's terms also apply.

5. Acceptable use

You may not use the Services to:

  • break the law or infringe other people's rights;
  • send spam, malware or content that harms others;
  • access accounts, data or systems without permission, or test the Services' security without our written consent;
  • overload, disrupt or work around the limits of the Services;
  • resell the Services or use them to build a competing service, unless we agree in writing.

We may suspend applications or accounts that put the Services, other customers or third parties at risk.

6. Early access and open source

Features labelled Early access, In development or similar are provided as is, may change and may be withdrawn. Dex and its connectors are open source; your use of their source code is governed by their own licenses, not by these terms.

7. Fees

Paid plans are described in an order form or on the Services when you subscribe. Fees are due as stated there and are not refundable except where the law requires. We will tell you in advance of any price change to a paid plan.

8. Ending the agreement

You may stop using the Services and close your account at any time. We may suspend or end your access if you materially breach these terms, or end the Services with at least 30 days' notice. After an account is closed, you may ask us within 30 days to export Your Content; after that we delete it, except where we must keep it by law.

9. Disclaimers

Except as expressly stated in a signed agreement, the Services are provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or free of errors.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services is limited to the greater of the fees you paid us in the 12 months before the claim and 100 US dollars.

11. Indemnity

You will defend and indemnify Super Durable against third-party claims arising from Your Content or from your use of the Services in breach of these terms or the law.

12. Changes to these terms

We may update these terms. We will post the new version here and, for material changes, notify account owners by email at least 15 days before they take effect. Continuing to use the Services after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. The state and federal courts in Delaware have exclusive jurisdiction over disputes about them.
